Professional Experience
Alejandro Menchaca’s practice includes every facet of patent, trademark, copyright, and related law. Alex has extensive experience in litigation and prosecution of patents, trademarks and copyrights and has prepared opinions in each of these areas.
Representative cases in the patent area include:
Heil v. McNeilus where Alex was principally responsible for briefing the motions for summary judgment that led to a finding of infringement in favor of the firm’s client, Heil, and resulted in a favorable settlement just days before trial was scheduled to commence.
Norian v. Stryker where Alex was principally responsible for preparation of the damages aspects of the case and where the jury found that a reasonable royalty would have been 0% if the patent had not been invalidated.
Minnesota Scientific v. Thompson Surgical where Alex had full responsibility of the matter and obtained a summary judgment of non-infringement for the firm’s client, Thompson Surgical, even before discovery commenced.
Representative experience in the trademark area includes:
Precious Moments protection program where Alex was principally responsible in assisting the firm’s client, Enesco, in policing its licensed mark PRECIOUS MOMENTS through opposition and cancellation proceedings in the United States and Trademark Office. Representative proceedings include: Enesco v. The Holson Co. (petition to cancel the respondent’s mark); Enesco v. Godinger. (petition to cancel the respondent’s mark); Enesco v. Playmates Holdings Ltd. (petition to cancel the respondent’s mark); Enesco v. Perma Frame (opposition to registration application); Enesco v. Heirloom, Inc. (opposition to registration application).
Representative cases in the copyright area include:
Hamilton v. Youngs, Inc. where Alex was principally responsible for the matter which resulted in a settlement favorable to the firm’s client, Hamilton, where the defendant acknowledged the validity of Hamilton’s copyrights and agreed to cease the infringement.
Hamilton v. Home Shopping Network Inc. where Alex negotiated a settlement in which the defendant acknowledged the validity of Hamilton’s copyrights and agreed to cease the infringement.
Noah v. Enesco where Alex was principally responsible for the matter and obtained a summary judgment dismissing all of the plaintiff’s claims including claims for copyright infringement.
Alex joined the firm on its founding with a “sabbatical” as an Assistant United States Attorney in the Northern District of Illinois, Criminal Division. As an Assistant United States Attorney, Alex was responsible for directing grand jury investigations leading to criminal indictments. He conducted numerous hearings and trials before many of the judges of the District Court for the Northern District of Illinois. He also represented the United States Attorney’s Office before the Court of Appeals for the Seventh Circuit in connection with several issues of first impression.
Alex is also an Adjunct Professor at the Loyola University School of Law having taught Intellectual Property Licensing and is an Adjunct Professor at The John Marshall Law School in Chicago having taught Patent and Trade Secrets Law, Unfair Competition and Consumer Protection, International Intellectual Property Law, and Patent Prosecution (in John Marshall’s Intellectual Property LLM. Program).
Alex is fluent in Spanish and has represented several clients who conduct business primarily in Spanish.
