Professional Experience
Edward W. Remus has successfully served as trial and appellate counsel in diverse areas of technology. He has also counseled clients – ranging from multinational corporations to start-ups – in a full range of complex intellectual property law matters. Mr. Remus’ success is based on the combination of his practical experience as a research chemical engineer (Sinclair Research), as a corporate patent attorney (UOP) and his 37 years of experience in private practice.
Notable successes include:
· Obtaining a summary judgment of patent invalidity under the “recapture rule,” which was affirmed on appeal by the Federal Circuit. The successful defense (improper recapture in a reissue patent) had never been asserted by at least three other major medical device companies, two of which opted to settle with the plaintiff for significant sums, and the third of which went through two trials and two Federal Circuit appeals with the plaintiff.
· Coordination of numerous patent litigations in Europe and Australia corresponding to patents being asserted in the United States.
· Successfully arguing a case before the Federal Circuit dealing with the patent provisions of the Hatch-Waxman Act.
· Defending – from trial through appeal – the entire product line of the leading manufacturer of soft contact lenses against allegations of patent infringement.
· Obtaining preliminary injunctions in patent infringement cases involving dental adhesives, agricultural chemicals, valves for controlling the flow of molten steel and pharmaceuticals.
· Serving as lead counsel in the Federal Circuit case of Amsted v. Buckeye, clarifying the marking and notice requirements of 35 U.S.C. § 287.
· Enforcing and defending patents directed to diagnostic clinical assays and recombinant chemistry.
Finally, at the conclusion of a recent two month trial before Judge Story in the Northern District of Georgia, Judge Story had this to say:
"I’ve tried hundreds, maybe thousands of cases in my life – I know I look too young to have tried that many cases, but believe me, I have. I was a lot younger when this case started than I am now. But I can honestly say I’ve never tried a case better prepared or better presented than this case was.
Each of you should be commended for your professionalism, for your preparation, for your knowledge, your grasp of the issues as factually as well as legally. . . . I just want to, again, say that it has been a pleasure having each of you in my court. . . . I feel that you have done everything that you could do on behalf of your respective clients to put your case before me."
Mr. Remus has authored and lectured extensively in the area of patent law and taught trial practice courses. He is active in intellectual property bar associations and various civic organizations, and is a member of the Richard Linn American Inn of Court, an organization working to foster and encourage civility in patent infringement litigation. Mr. Remus has also been identified as one of the world’s leading patent experts by Euromoney Publications PLC as well as recognition as a Leading Lawyer and Super Lawyer.
