Professional Experience
Jean Dudek Kuelper’s clients include Fortune 500, mid-size and startup companies as well as several Universities. She has considerable experience working in the fields of telecommunications, software, advance display technology, barcode printing and scanning, ophthalmological devices, implanted electronic medical devices, optics and lasers.
Ms. Kuelper, as lead trial counsel, won a $63.75 million settlement for her client Paxar Americas against Zebra Technologies Corporation prior to a decision on claim construction and Paxar’s Motion for Summary Judgment. The lawsuit, which was pending in the Southern District of Ohio, involved the software, electronics and mechanics of 50 barcode printers accused of infringing 8 Paxar patents.
Ms. Kuelper, as lead trial counsel, also won a $10 million arbitration award for her client, a State University. The arbitration was a three week trial involving breach of a license agreement and patent infringement before a three member arbitration panel. The technology was related to an electronic medical device.
As lead trial counsel representing the defendant in a patent infringement suit pending in Boston, Ms. Kuelper obtained a voluntary dismissal of the suit with prejudice after raising a possible Rule 11 violation by the plaintiff.
She was also lead counsel representing the patent owner in litigation involving software patents as well as electrical and mechanical patents directed to printing technology. Towards the close of discovery, she negotiated a settlement valued at over $30 million dollars for her client.
In representing a defendant in major patent litigation that resulted in a successful jury verdict after a two-month trial, Ms. Kuelper’s depositions of technical expert and fact witnesses resulted in the patent owner dropping one contested patent before trial and conceding no literal infringement of a second contested patent. In other litigation representing defendants, she has obtained summary judgments of noninfringement.
Ms. Kuelper has also appeared before the European Patent Office as an expert witness for the patent owner in a contested nullity (invalidity) suit. The result was a decision in favor of the patent owner upholding a basic patent on a hand-held labeler. She has also successfully argued numerous cases before the U.S. Patent and Trademark Office Board of Appeals and Interferences.
Besides software and electrical patent litigation, Ms. Kuelper has negotiated complex technology licenses, several of which have involved multiple parties. She has negotiated royalties in licenses of 10% and higher for her clients. Ms. Kuelper also counsels clients on patent acquisition. She has been responsible for the acquisition of major patent portfolios before the U.S. Patent and Trademark Office, typically working with Ph.D’s in high technology areas. For several of her start-up company clients, she acquired patents that were sold for tens of millions of dollars.
