Professional Experience
James P. Murphy has practiced law for nearly fifteen years, and in all areas of intellectual property and related commercial litigation.  His practice includes the acquisition and management of patent, trademark, and copyright protection.

Jim's litigation experience includes two years as a Law Clerk to a United States District Court Judge in the Northern District of Illinois, followed by his private practice which has included all phases and aspects of litigation, including participation in trials, Markman hearings, TRO and preliminary injunction proceedings, and appellate practice. Jim represents numerous clients with regard to sales, purchases and other transfers of intellectual property rights, and related corporate transactions.

Jim counsels clients and litigates in a diverse range of technologies, including  telecommunication systems, electronics manufacturing, lighting systems, electro-mechanical gaming devices, hospital kinetic bedding, home consumer products, organoclay and other chemical processing technology, financial pricing model methodologies, dental x-ray technology, implantable cardiac defibrillators and pacemakers, balloon angioplasty catheters, spinal implants and surgical tools, and open-heart surgery tools and devices.  In addition to numerous patent matters, Jim also has substantial involvement in litigation involving areas of antitrust, trade secret, trademark and trade dress, copyrights, as well as Lanham Act cases relating to trafficking in “gray market” goods.  

Jim has successfully represented plaintiffs and has achieved verdicts or settlements for clients resulting in collections of millions of dollars; and has successfully defended against various charges of infringement and other assertions of intellectual property violations on behalf of defendants.  Jim represents a diverse and growing group of clients ranging from international electronics products manufacturers and telecommunications concerns, to individual inventors and businesspeople.
