Professional Experience
Michael J. Fitzpatrick is an attorney specializing in intellectual property law, including patent, trademark, and anti-trust matters.
During law school, Michael served on the editorial board of the Virginia Journal of Law & Technology and was involved in Moot Court both as a participant and later as a judge. He was a founding member of the Irish-American Graduate Students Association; wrote and acted for his law school’s annual Libel Show; and participated in several intramural sports leagues, including serving as a commissioner for the North Grounds Softball League.
Upon graduating from the University Of Virginia School Of Law in May 2001, Michael joined McAndrews, Held & Malloy. In September 2002, he left private practice temporarily to pursue a federal clerkship. For the next year, he served as law clerk to Chief Judge Charles P. Kocoras of the United States District Court for the Northern District of Illinois. The clerkship proved to be incredibly valuable, allowing him to hone his legal research and writing skills, witness litigation from a judicial perspective, and be mentored by a great teacher and federal judge. In October 2003, he returned to the firm and resumed private practice.
Michael has been involved in patent litigation concerning various technologies, such as cosmetic contact lenses, lighting controls, surgical gowns, radiopharmaceutical pigs, and desiccant-entrained polymers for packaging of medical test strips. He recently participated in a patent infringement bench trial in the Southern District of Indiana where the McAndrews trial team successfully convinced the judge that the asserted patent was valid and infringed, ultimately leading to a favorable settlement of $8 million.
Michael also has substantial experience in patent interferences, having worked on interferences concerning inventions relating to treating stroke and myocardial infarction and inventions relating to hematology analyzers and controls. Additionally, he has significant experience in patent prosecution and reexamination procedures, freedom to operate opinions, and trademark registration.
