Professional Experience
Michael Fitzpatrick practices a broad range of intellectual property law but specializes particularly in patent law, where he has extensive experience practicing in federal courts and before the United States Patent & Trademark Office.
Michael has litigated patents in federal court involving various technologies, such as optical lens generators, cosmetic contact lenses, lighting controls, surgical gowns, GPS devices, radiopharmaceutical containers, and desiccant-entrained polymers for packaging of medical test strips. In a patent infringement bench trial in the Southern District of Indiana, he helped successfully convince the judge that a client’s asserted patent was valid and infringed, ultimately leading to a favorable settlement of $8 million.
Michael has litigated patent interferences at the Patent & Trademark Office concerning inventions relating to treating stroke and myocardial infarction and inventions relating to hematology analyzers and controls. He has prosecuted numerous patents on behalf of large clients as well as individual inventors, has successfully challenged adverse patents through reexamination proceedings, and has counseled clients in freedom to operate investigations.
Michael earned a Bachelor of Science in Bioengineering from the University of Illinois and his Juris Doctor from the University of Virginia. Upon graduating from Virginia, Michael joined McAndrews, Held & Malloy. In September 2002, he left private practice temporarily to pursue a federal clerkship. For the next year, he served as law clerk to Chief Judge Charles P. Kocoras of the United States District Court for the Northern District of Illinois. The clerkship proved to be incredibly valuable, allowing him to hone his legal research and writing skills, witness litigation from a judicial perspective, and be mentored by a great teacher and federal judge. In October 2003, he returned to the firm and resumed private practice.
