Professional Experience
Patricia J. (PJ) McGrath has experience in all areas of intellectual property law involving patents, trademarks, trade secrets, and copyrights as well as antitrust matters. PJ’s practice includes all phases of litigation, International Trade Commission proceedings, prosecution, and mediation, with particular emphasis on patent litigation and Section 337 investigations before the ITC. PJ’s litigation experience includes client victories in various patent actions, including a four-week jury trial resulting in a patent infringement award of over $80 million with a finding of willful infringement (reversed in part and remanded) and ITC Section 337 investigations and hearing/trial representing both domestic and foreign parties. PJ also assists clients in counseling, opinion development, licensing, intellectual property portfolio management, transactional issues, and settlement negotiations and agreements.
PJ’s experience covers a diverse range of technologies, with a particular focus on chemistry and biochemistry disciplines, such as industrial chemicals, polymers, polyols, polyurethanes, surfactants, pigments, additives, personal care products, catalysts, metals, refrigerants, oil refining, nutritional supplements, and coatings. PJ’s experience also covers additional technologies, including medical devices, lighting, rail car wheels, golf balls, and computer hardware and software and internet communications.
PJ holds a bachelor of science degree in biology from St. Xavier University, and a bachelor of science degree in chemistry from Elmhurst College, where she graduated with honors. Prior to practicing law, PJ worked as both a research and development and technical chemist for two Fortune 500 industrial chemical manufacturers. During that time, PJ focused on inorganic and organic chemicals and chemistries for the paint, coatings, sealant, ink and adhesive markets. PJ has found that the combination of her undergraduate degrees, technical work experience, and law degree provide a solid foundation for uniquely practicing intellectual property law in a corporate setting.
PJ attended Chicago-Kent College of Law, where she graduated with High Honors and was a Notes and Comments Editor of the Chicago-Kent Law Review. She is also a member of the Order of the Coif.
